Terms of Service

By accessing or using Futuracom’s services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services. These Terms constitute a legally binding agreement between you and Futuracom.

Futuracom provides a WhatsApp Business messaging platform that enables businesses to:

• Send and receive messages through WhatsApp Business API
• Manage customer conversations in a shared inbox
• Automate responses using AI-powered assistants
• Analyze messaging performance and customer engagement
• Integrate with third-party services and applications

3.1 Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization.

3.2 Account Responsibilities

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.1 You Agree To:

• Comply with all applicable laws and regulations
• Respect the rights and privacy of others
• Use the service only for lawful business purposes
• Follow WhatsApp’s Business Policy and Commerce Policy

4.2 You Agree Not To:

• Send spam, unsolicited messages, or bulk promotional content
• Transmit malware, viruses, or harmful code
• Attempt to circumvent security measures or access restrictions
• Impersonate others or misrepresent your identity
• Use the service for illegal activities or to harm others
• Reverse engineer, decompile, or disassemble our software
• Resell or redistribute the service without authorization

5.1 Billing

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms.

5.2 Price Changes

We may change subscription prices with 30 days’ notice. Price changes take effect at the start of your next billing period.

5.3 Payment Failure

If payment fails, we will attempt to collect payment for up to 7 days. After this grace period, your access may be suspended until payment is received.

6.1 Our Rights

Futuracom owns all rights, title, and interest in the service, including all software, designs, trademarks, and content created by us.

6.2 Your Rights

You retain ownership of all content you submit through the service. By using our service, you grant us a limited license to process and store your content as needed to provide the service.

Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the service, you consent to our data practices as described in the Privacy Policy.

Our service integrates with third-party services including WhatsApp, payment processors, and AI providers. Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services.

We strive to provide 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or circumstances beyond our control.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Futuracom shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss of data, revenue, or business opportunities

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

You agree to indemnify and hold harmless Futuracom and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these Terms.

13.1 By You

You may cancel your subscription at any time through your account settings. Access continues until the end of your current billing period.

13.2 By Us

We may suspend or terminate your access immediately if you violate these Terms or engage in conduct that harms us or other users.

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of the jurisdiction where Futuracom is incorporated, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits.

• Entire Agreement: These Terms constitute the entire agreement between you and Futuracom.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign your rights under these Terms without our consent.
